Supreme Court Decides US Government Responsible for Covering Overhead Costs of Tribal Health Care Programs

In a landmark decision, the Supreme Court has ruled that tribes have the right to control their own healthcare programs and receive funding for overhead costs incurred when billing private insurance companies, Medicare, and Medicaid. This ruling is a victory for tribal communities across the country who have been struggling with healthcare funding disparities.

The Northern Arapaho Tribe in Wyoming and the San Carlos Apache Tribe in Arizona were among the first to challenge the government over significant overhead costs they faced while managing their own healthcare programs. The Northern Arapaho Tribe spent $1.5 million on billing costs over two years, while the San Carlos Apache Tribe spent nearly $3 million over three years. However, this decision could result in the federal government paying between $800 million and $2 billion annually for all tribes that manage their own healthcare programs, as estimated by the Department of Health and Human Services.

This decision is a major step towards addressing healthcare disparities for tribal communities nationwide. According to Morgan Saunders, an attorney with the Native American Rights Fund, this ruling allows tribal nations to have control over what is best for their communities and ensures that health care programs managed by tribes are on par with those operated by the IHS. This decision will help ensure that tribal communities receive adequate funding for healthcare services and will help address longstanding disparities in health outcomes between tribal and non-tribal populations.
