Judge reduces penalties for Netflix’s disclosure of health plan information.

Netflix Inc. recently obtained a court order that significantly reduced the penalties it was required to pay to an employee’s husband in relation to a delay in responding to his request for documents regarding the company’s health plan. The original decision, made in January, had mandated Netflix to pay $6,465 in penalties under the Employee Retirement Income Security Act. However, Judge Edward J. Davila stated in a June 7 opinion that this ruling was mistaken as it misunderstood the timeline of the plaintiff’s document requests and Netflix’s responses.

According to the prior order, Netflix was found to have inadequately responded to the request in January 2021, waiting until March 2022 to provide sufficient information. Judge Davila clarified that the information requested was actually provided by Netflix in February, not March as previously stated. This error in analysis led to the penalties being reduced upon further review of the case.
